Abstract
In this paper we analyzed theoretical content of the passive personality principle in criminal law. We have an opinion that it originates from Personalitätssystem. But russian doctrine relates it to the protective principle (also known as Schutzprinzip, Realprinzip, Realschutzprinzip, Staatsschutzprinzip, prinzipe de rea-lite, prinzipe de defense). We built our conclusions on the study of Harvard Law School, 1935. After that, we analyzed criminal law-content of some Europian countries, such as: Germany, France, Austria, Greece, Italy.
